After an initial notice last week from its landlord, Maloney's Tavern on Market Street now faces a court summons in August for failing to pay rent, taxes, and other fees.
The popular LoDo watering hole received on July 14 a demand for overdue payment to the tune of $58,691.85 to be paid within three days to property owner Larimer Associates.
"This is not a seizure situation," Carolyn Waldmann, general manager of Larimer Square and director of property management, said in an email. However, as of Monday, she and her team were "uncertain as to the Tenant's intent to cure the default or vacate."
This week, a second notice has been posted to the pub door from the District Court with the City and County of Denver, demanding Maloney's on Market LLC to appear before the court on August 4 at 10 a.m. to answer the complaints of Larimer Square Parking LLC.
The court summons Maloney's "...for failure to cure your default, for future damages, costs, reasonable attorneys' fees and such other relief... ."
The attorney representing Larimer, Steven W. Kelly with Silver & DeBoskey, was reached but offered no comment, and neither Maloney's staff nor ownership were immediately available.
Maloney's, which serves traditional Irish pub fare and beverages, has locations in Flagstaff, Tucson and San Diego, as well as in Denver.
